While I agree with the reasoning and result of the majority opinion, I am compelled to write further by what I perceive to be the fundamental problem of the cause sub judice; that is, the procedural “comedy of errors” which gave rise to this action. The occurrence of such procedural nightmares results from the veritable jurisprudential quagmire which exists in this state in the area of appellate review of administrative decisions.
