Plaintiffs-appellants, John Davey and Nelson Smith (“the officers”), appeal from an adverse judgment rendered after a bench trial upon their complaint for a declaratory judgment, promotion, and back pay. The officers contend that the trial court erred in holding, as a matter of law, that the vacant positions to which they sought to be promoted could be abolished before being filled.
