This matter is before the Court on the motion of Plaintiff Shanti, Inc. (“Shanti”), d/b/a Moghals Fine Indian Cuisine Restaurant (“Moghals”), for summary judgment and Defendants’ cross motion for summary judgment and motion to dismiss for lack of subject matter jurisdiction.
