FRANCIS, United States Magistrate Judge.

After being convicted in New Hampshire for conspiring to murder her husband, Pamela Smart was transferred to a New York State prison. Ms. Smart then filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 in the Southern District of New York, naming the Commissioner of the New York State Department of Correctional Services as respondent.
