I. INTRODUCTION
Defendant, Jose Hernandez, is charged in a one-count indictment for failure to update his registration as a sex offender under the Sex Offender Registration and Notification Act (“SORNA”), in violation of 18 U.S.C. § 2250. On January 6, 2009, Defendant filed the instant Motion to Dismiss Indictment. The Government responded to Defendant’s Motion.
