This action is brought to recover damages for the death of plaintiff’s intestate, alleged to have occurred in Massachusetts through the negligence of the defendants, who pleaded as a special defense that at the time of the injury complained of there was in force §9 of Chapter 346 of the Acts and Resolves of Massachusetts for the year 1925, to wit: “A person who by his negligence or by his wilful, wanton or reckless act, or by the negligence or wilful, wanton or reckless act of his agents or servants while engaged in his business, causes the death of a person in the exercise of due care, who…
