This action was brought to recover damages for deceit. The complaint charged that plaintiff was induced through the false representations of defendants to purchase stock of the Union National Bank of Oakland at a gross over-valuation, whereby plaintiff sustained damages in the sum of thirty-seven thousand four hundred dollars, alleged to be the difference between the price paid for the stock and its actual value at the times of purchase.
