— Appellants are the City of Los Angeles and two arson investigators who shot and killed William Munoz in the early morning hours of May 19, 1973. Respondents are his widow and children, plaintiffs in this wrongful death action.

*631Several arson incidents involving commercial property in Munoz’ neighborhood had been reported. On the night of the shooting defendants Olin and Halstead were staking out the area as arson investigators for the city, with the status of peace officers (Pen. Code, § 830.3, subd.
