Appeal by the plaintiff, the Navarre Hotel and Importation Company, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 20th day of December, 1911, upon the dismissal of the complaint by the direction of the court at the' close of plaintiff’s case on a trial at the New York Trial Term.

In January, 1909, one Gibbs was indebted to the plaintiff, a domestic corporation, in the sum of $1,590, which he was unable to pay. He had in his rooms in the plaintiff’s hotel certain furniture, bric-a-brac, paintings, and other personal property, upon which he offered to give a chattel mortgage to obtain an extension of the time within which payment might *796be made, and to secure the payment thereof.
