MEMORANDUM OPINION

ALBERT E. RADCLIFFE, Bankruptcy Judge.

This adversary proceeding is before the court for a decision upon the record.

PROCEDURAL BACKGROUND

The plaintiff, the Chapter 7 trustee, herein, filed his complaint against the defendant on December 12, 1988 to recover fees paid to the defendant, a former attorney for the Chapter 11 debtor-in-possession, without prior court authorization. There are two claims for relief. The first is brought under 11 U.S.C. § 542 to require the defendant to turn over to the trustee property of the estate which the defendant received post-petition.
