Tbe policies of insurance, upon which tbis action was begun, issued on 13 April, 1923, and insuring plaintiff, E. Y. Dawson, for one year, against tbe loss of tbe property described therein, by fire, were in force on 2 June, 1923, tbe date of tbe destruction of said property (1) unless said policies were delivered upon condition tbat they should not become effective until tbe premiums were paid, or (2) unless tbe policies were canceled on 30 April, 1923, as contended by defendants.
