This was an action by Marilla L. Crow, administratrix of the estate of Jonathan S. Crow, deceased, against the *749Omaha & Republican Valley Railway Company, to recover damages arising from the death of plaintiff’s intestate alleged to have been caused by the negligence of the defendant. From an adverse judgment the defendant once before prosecuted error proceedings to this court, and the judgment was reversed for error in the instructions. (Omaha & R. V. R. Co. v. Crow, 47 Neb. 84.)
