This action was instituted in the justice’s court by appellant "V". Sands for the recovery of unpaid rent under an alleged written lease from him to respondent, Eagle Oil and Refining Company, Incorporated. Respondent denied that the parties entered into said lease and with authorization of the court filed a cross-complaint bringing in appellant J. H. Tarman as a cross-defendant. As amended the cross-complaint alleged in substance that said Tarman was respondent’s agent for the negotiation of the lease but that he secretly acted in his own interest and as agent of Sands and induced respondent…
