This is an appeal from a judgment of the District Court of Collin County overruling appellants’ pleas of privilege. The action was instituted by Lesla Box and Harry B. Elder, as plaintiffs, against Guy Morgan, Ed F. Morgan, McKinney Building Corporation and M P-Morgan Portable Buildings, Inc. (hereinafter referred to as M P), as defendants. Plaintiffs sued both in their individual capacity and also in a derivative action for the use and benefit of McKinney Building Corporation, and all shareholders similarly situated.
