Backhaus v. Lee

This is an appeal from the district court of Emmons county, third judicial district, from an order of the trial judge, vacating a temporary restraining order and denying a permanent injunction.

The plaintiffs are taxpayers of Emmons county and brought this suit to enjoin the issuance of warrants for disbursement of money out of the bridge fund of the county in payment for nine structures built under three separate contracts between Emmons county and the; defendant and respondent Eogel, doing business under the name of the Linton Eridgo and Construction Company.
