DECISION AND ORDER GRANTING DEFENDANT’S MOTION TO DISMISS

I. INTRODUCTION

Plaintiff Lawrence Guardino (“Plaintiff” or “Guardino”) brings this action pro se under the Americans with Disability Act (“ADA”), 42 U.S.C. § 12101 et seq., against his former employer, defendant Village of Scarsdale Police Department (“Defendant” or “SPD”). Guardino alleges that SPD unlawfully discriminated against him in violation of the ADA when SPD terminated Guardino for failing to be present at his post.
