The action in which the judgment appealed from was rendered was assumpsit on an insurance policy issued to Simon Weise, deceased, insuring him in the sum of $5,000, “ against bodily injuries sustained through external, violent and accidental means.” The policy contains the following clause:
“If death shall result within ninety days from such injuries, independently of all other causes, the company will pay the principal sum of the policy to Minnie Weise, his wiie, if surviving, or, in the event of her prior death, to the legal representatives of the assured.” * * * “In case of injuries, fatal…
