Plaintiff, the Incorporated Village of Garden City (“plaintiff’ or “the Village”) brought this action on December 14, 2007 against Genesco, Inc. (“Genesco”) and Gordon-Atlantie Corp. (“Gordon-Atlantic”), alleging that defendants bear responsibility for toxins released into the Village’s water supply. Plaintiff asserts claims under the following federal laws: (1) the Resource Conservation and Recovery Act, 42 U.S.C. §§ 6901 et seq.
