This is an action brought by the respondent to enforce a lien for work done in getting out saw logs, and to charge the appellant and the partnership of which he was a member for the amount of the lien because of their conversion of the logs.' The first objection is that the complaint does not state a cause of action. This was not raised by demurrer, but is raised for the first time in this court.
