This is the second petition filed by the Labor Board in this proceeding to enforce its order, based upon a summary judgment of the Administrative Law Judge, that Caravelle violated §§ 8(a)(1) and (5) of the National Labor Relations Act (Act) 1 by refusing to bargain with the Union.2 The Board originally ordered Caravelle to bargain; the first petition followed; and this court denied enforcement and remanded for further proceedings. 466 F.2d 675 (1972) (Caravelle I). We now order enforcement of the Board’s present order.
