This appeal is by the defendant from a judgment against him in an action for damages occasioned by an automobile collision on highway No. 40, near Victory Junction, on *476October 2, 1932. No. 40 is an east-and-west highway. The plaintiff was going east thereon to Kansas City, and the defendant was coming west thereon to Lawrence. That would properly put the plaintiff on the south side of the highway and the defendant on the north side thereof.
