Marshall, J.:

The defendant appeals from a judgment rendered in favor of the plaintiff for injuries sustained by him in a railroad-crossing accident.

The plaintiff, a boy ten years old, was riding with his mother in the rear seat of an automobile driven' by his father. The father attempted to drive the automobile across the railway track in front of an approaching electric car.
