OPINION

DRAUGHN, Justice.

The State Bar of Texas appeals from a judgment finding that Marcus E. Faubion, appellee, did not violate the Texas Code of Professional Responsibility. The State Bar contends that appellee falsely represented that he was certified by the Texas Board of Legal Specialization and that he split fees with a non-lawyer. The case was submitted to the court on an agreed statement of facts pursuant to Tex.R.Civ.P. 263. The trial court found no professional misconduct on the part of appellee.
