On August 1, 1922, plaintiffs purchased from defendants, on land contract, a dwelling on Fulton avenue, in the city of Detroit, for the sum of $4,600. Plaintiffs paid down $1,946.25, leaving a balance of $2,653.75, to be paid at the rate of $45 per month, with interest on unpaid balance at 6 per cent. Plaintiffs got in arrears as to some of the payments and defendants, on the 4th day of April, 1923, commenced an action before a circuit court commissioner to eject them. This action resulted in a judgment for restitution and the plaintiffs were accordingly evicted.
