Plaintiff, Cody Cubler, appeals from the order dated October 23, 2012, wherein this court granted defendant, Trumark Financial Credit Union’s motion for judgment *233on the pleadings thereby dismissing plaintiff’s complaint.

FACTUAL BACKGROUND

Plaintiff commenced this consumer class action by filing his complaint on April 16,2012. (See docket).
