The defendant was charged in two counts of an information with lewd and lascivious acts committed on April 1, 1948, upon two sisters, aged respectively 9 and 10 years, contrary to the provisions of section 288 of the Penal Code. The defendant failed to take the witness stand in his own behalf. The jury convicted him on both counts. He was sentenced to state prison for the term prescribed by law.
