This was an action for overtime, liquidated damages, and attorneys’ fees brought under the Fair Labor Standards Act, 29 U. S. C. A., § 201 et seq. The trial court sustained a demurrer to plaintiff’s evidence and he has appealed.

In his petition, filed June 11,1941, plaintiff alleged that defendant is a producer, refiner and marketer of petroleum and its products and is engaged in interstate commerce; that about October 25, 1938, defendant notified its employees that it was under and intended to comply with the Fair Labor Standards Act; that…
