An action of trespass on the case was brought to the February rules, 1888, in the Circuit Court of Kanawha count}', by John W. Smith and Leonora Smith, his wife, against the County Court of Kanawha county. On the 28d day of March, 1888, on the plaintiff’s motion, the case was remanded to rules, with leave to, them to amend their declaration, and on the 3d day of January, 1889, the defendant appeared by counsel, and demurred to the plaintiff’s declaration,, which demurrer, being argued by counsel, and considered by the court, was overruled, and thereupon the defendant pleaded…
