HICKS, District Judge.

Presently before the Court is Plaintiffs Motion for Summary Judgment (Docket No. 5) and the Defendant’s Motion to Dismiss (Docket No. 8). Defendant has filed an opposition (Docket No. 12) to Plaintiffs motion. In response to Defendant’s motion, Plaintiff filed an opposition (Docket No. 9), to which Defendant subsequently replied (Docket No. 11). Plaintiff has filed an additional pleading entitled, “Reply in Opposition to Defendant’s Motion to Dismiss,” (Docket No. 13) which appears to be a sur-reply filed in the matter.
