The facts of the case were previously recorded in the unpublished opinion Estate of Carlsen v. Carlsen, COA02-463, 2003 WL 21030462 (filed 6 May 2003).

Christian Elmer Carlsen (decedent) married Roberta C. Carlsen (Mrs. Carlsen) on 3 December 1932. The couple lived together in Fort Lauderdale, Florida until 1997. Decedent and Mrs. Carlsen had three children during their marriage, including Christian Edward Carlsen (Christian), Shirley Hart *583(Shirley) and Roberta Jane Carlsen (Roberta Jane).
