MEMORANDUM OPINION AND ORDER

In its First Amended Complaint GLS Development, Inc. (“GLS”) has sued both Wal-Mart Stores, Inc. (“Wal-Mart”) (Count I) and DiMucci Development Corporation (“DiMueci”) (Count II), charging each with breach of contract. This Court’s May 30, 1996 memorandum opinion and order (the “Opinion,” 1996 WL 296594) denied a motion by DiMucci for summary judgment under Fed.R.Civ.P. (“Rule”) 56.
