I. Introduction

This case is an asbestos-related insurance dispute between an excess insurer and its reinsurer over how much, if any, of the payments made by the excess insurer to its direct insured constitute covered loss under the reinsurance contract. Before this Court are the parties’ respective objections to the Report and Recommendation of Magistrate Judge Martin concerning the parties’ cross-motions for summary judgment.
