Near 8 o’clock P. M. on July 21, 1940, appellant, Jack Johnson, in Boone County, Kentucky, shot and killed Lucian Black. He was later indicted for murder, and on his trial in that court he was convicted of voluntary manslaughter and punished by confinement in the penitentiary for ten years. His motion for a new trial was overruled, and from the judgment pronounced on the verdict he prosecutes this appeal, relying chiefly and almost entirely on the alleged insufficiency of the testimony to support the verdict — and, as a consequence thereof, his…
