OPINION OF THE COURT ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

McKEAGUE, District Judge.

This is a tort action under state law growing out of injuries sustained by plaintiff while shopping at defendant’s store in Fremont, Michigan. Originally filed in the Newaygo County Circuit Court, defendant removed the action to this Court based on the parties’ diversity of citizenship. Defendant has now moved for summary judgment on all claims.
