This is an appeal from an order of the district court denying, without a hearing, defendant’s petition for a writ of habeas corpus.

Defendant was charged with violating Minn. St. 1961, § 622.18, of the old Criminal Code by receiving on August 15, 1963, stolen property valued at $50. On September 12 he appeared in the municipal court of the city of Detroit Lakes pursuant to his demand for a preliminary hearing.
