REAL PROPERTY – FORECLOSURE – DEFICIENCY JUDGMENT Deficiency judgments under Maryland Rule 14-216(b) allow secured parties or parties in interest to obtain an in personam judgment if there is a deficiency after the completion of an in rem mortgage foreclosure proceeding. Deficiency judgments are initiated by a motion filed after the primary foreclosure case has concluded, and after ratification of the audit, the fact and amount of the deficiency are adjudicated and not subject to re-litigation.
