This wias an action upon an open account, commenced by 'the defendant in error, plaintiff below, against the plaintiff in error, defendant below. The petition, which was in the usual form, with a verified statement of account attached thereto, further alleged that prior to the commencement of.the action the defendant acknowledged the correctness of the account sued upon, and agreed that the amount due should bear interest at the rate of 8 per cent, per annum for the ,purpose of inducing the plaintiff to withhold suit and extend the time of payment for a short time, and that said extension has…
