—Judgment, Supreme Court, New York County (Paul Bookson, J.), rendered January 7, 1992, convicting defendant, after jury trial, of criminal sale of a controlled substance in the third degree, and sentencing him, as a second felony offender, to a term of 4Vi to 9 years, unanimously affirmed.

Defendant did not object to the trial court’s jury charge on reasonable doubt and thus failed to preserve any claim of error as a matter of law (CPL 470.05; People v Thomas, 50 NY2d 467).
