Judgment, Supreme Court, Bronx County (Dominic Massaro, J.), rendered February 16, 1995, convicting defendant, after a jury trial, of attempted robbery in the first degree and criminal possession of a weapon in the fourth degree, and sentencing him to concurrent terms of 5 to 10 years and 1 year, respectively, unanimously affirmed.

Defendant’s motion to dismiss the indictment pursuant to CPL 30.30 was properly denied. Defendant’s motion papers were insufficient to establish that defendant’s right to a speedy trial had been violated, because his moving papers did not contain sworn allegations…
