Plaintiffs Sanderson Farms, Inc. (“Sand-erson”) and Perdue Farms, Inc. (“Perdue”) (collectively “Plaintiffs”) bring this suit against Tyson Foods, Inc. (“Tyson” or “Defendant”), alleging violations of section 43(a) of the Lanham Act, 15 U.S.C. § 1125(a), which prohibits false or misleading advertising and unfair trade practices in interstate commerce.
