HERLANDS, District Judge.

This is a proceeding under Title 18 United States Code, Section 401, subdivision (3), and Federal Rules of Criminal Procedure, Rule 42(a), 18 U.S.C.

The issue is whether the respondent Domenico Bando may properly assert his Fifth Amendment privilege to justify his refusal to answer six certain questions which are quoted in the course of the Court’s opinion, and whether he may properly assert his Fifth Amendment privilege to justify a refusal expressed in open court that he would refuse and does refuse to comply with the Court’s direction to answer those questions…
