RONEY, Senior Circuit Judge:

The Government appeals two rulings made by the district court preparatory to the retrial of defendant Guy Joseph Duchi after this Court reversed his conviction because illegally seized evidence was admitted at his first trial. United States v. Duchi, 906 F.2d 1278 (8th Cir.1990). First, the Court ruled that the Government could not argue a different ground for the introduction of the evidence that this Court had held to be illegally obtained.
