MUNGER, District Judge.
The appellant filed a petition for a writ of habeas corpus, alleging that he was unlawfully confined in the United States penitentiary at Reavenworth, Kan. There is no dispute about the facts. An indictment was returned against appellant in the United States District Court for the District of Indiana, which contained two counts. The first count charged:
