Convolve, Inc., and Massachusetts Institute of Technology (collectively, “Convolve”) have asserted claims of patent infringement and theft of trade secrets against Compaq Computer Corp. (“Compaq”) and Seagate Technology, Inc. (“Seagate”). Seagate manufactures disk drives, while Compaq produces and distributes computer systems. Pursuant to a confidentiality agreement, Convolve shared proprietary information with the defendants concerning technology that allows a computer user to choose between faster and quieter modes of operation.…
