Plaintiffs Gordon Partners, Frederick L. Gordon and Sam D. Gordon (“Gordon” or the “Gordon plaintiffs”) have moved for discovery sanctions against defendant NTL Europe, Inc. and “nominal non-party NTL, Inc.,” claiming that they hindered and delayed document discovery in this case and allowed numerous documents and electronically stored information (“ESI”), including the e-mails of approximately forty-four of NTL’s “key players,” to be destroyed.
