Plaintiff recovered judgment in this case. Defendant *349moved for a new trial on the grounds : (1) Insufficiency of the evidence to justify or support the finding’s and decision of the court, and that such decision is against law ; (2) that the decision and judgment of the court are not supported by the findings.
