The respondent moves to strike out the statement on motion for new trial, upon the ground that no notice of intention to move for a new trial was given. The record does not contain any such notice, and the only reference thereto is in the opening of the statement on the motion, where it is said that the appellant “ makes his motion for a new trial on the grounds mentioned in his notice of motion made and filed.” He now, however, under a suggestion of diminution of the record, offers what purports to be a copy of such notice, containing an admission by respondent’s…
