On November 28, 1989, plaintiff, Provident Life and Accident Insurance Company, initiated this action for preliminary in-junctive and declaratory relief against the defendants, Thomas L. Linthicum, Patricia Linthicum, and Christy Linthicum. Plaintiff is the administrator of a self-insured employee health benefits plan for Tyson Foods, Inc. and the plan is subject to the provisions of the Employee Retirement Income Security Act of 1974, as amended, 29 U.S.C. § 1001, et seq.
