This cause comes on to be heard upon a motion to dismiss the appeal filed by the defendants in error. Counsel for plaintiff in error admits that said cause was brought to this court by a certified transcript, and that the error com plained of is in overruling the demurrer of the plaintiff in error to the third amended petition in this case, in rendering judgment against the plaintiff in error, that this cause was passed upon by this court when the said case was before it on another appeal, and that this court has nothing to do, if it adheres to its former ruling, but affirm the judgment of…
