This proceeding in error is to review the judgment in an action instituted in the United States Court for the Southern District of the Indian Territory, at Ryan, on February 11, 1904, by the plaintiff in error, as plaintiff, against the defendants in error, as defendants, declaring in his complaint upon a certain contract.
On May 15, 1905, judgment was rendered in favor of the plaintiff. An appeal was prosecuted therefrom by the defendants to the United States Court of Appeals for the Indian Territory, at McAlester. On September 26, 1907, the judgment of the trial court was reversed. (Kelly et…
